ND Smokers -Puff Away if You Are 21 Years Of Age.
When was the last time you were carded? Bringing out your driver's license (with the most hideous picture in mankind's history) and proving your age to buy alcohol? Well obviously the older we get, the more we HOPE to be asked for identification. Here in Bismarck, North Dakota - there has been some confusion on just how old you need to be to purchase tobacco. Some people may have not heard when the law was raised from 18 to 21 years of age, but wait I'm confused (join the crowd). According to KFYR North Dakota law states that smoking IS legal at the age of 18 (here is where the BUT comes in) BUT a federal law says "Hold your horses and your lighters", because about a year ago they overrode that smoking age to 21. North Dakota is not the only state that changed its state laws to comply, 35 states in all have made that move.
Sen. Michael Dwyer, R-Bismarck. felt the confusion as well “After I agreed to sponsor this bill I knew that North Dakota’s law was 18, but I was in convenience stores and I’d say, ‘how old do you have to be to buy cigarettes?’ and they’d say 21,” The key question here is WHEN - WHEN do the sellers of tobacco need to be up to speed and make sure that the federal laws are being followed?. Now, the Senate Judiciary Committee has added an emergency clause to the bill, stressing the importance to quickly change the state law to age 21. I'm going to go ahead and say that NOW that should clear it up for everyone.
